Welcome to Artmygod – a space where fine art meets personalization. Please review our Terms carefully before using our site or placing an order. These Terms of Service (“Terms”) govern your use of Artmygod (“we”, “us”) and any related services (e.g. purchasing, custom artwork). By using the Site or placing orders, you agree to these Terms.
- Definitions
- “Customer / You / Your” – person using the Site, purchasing, commissioning artwork
- “Artwork / Products” – original paintings, customized paintings, premium paintings
- “Commission / Custom Orders” – artwork created per your specifications
- Ordering & Commission Process
- You place orders via the website. For custom paintings, you provide specifications (size, reference image, style, etc.).
- We will provide an estimated delivery / dispatch timeframe (typically 1–4 weeks, depending on complexity, seasonality, weather).
- We reserve the right to refuse any order or request.
- Changes after order confirmation may incur additional charges or delay.
- Payment & Pricing
- Pricing is as listed on the Site (may exclude taxes, shipping)
- You pay via the integrated payment gateways (we do not store full payment card data)
- All payments must clear before production or dispatch
- Prices and availability are subject to change until order is confirmed
- Sales tax, customs duties, or import fees (for international orders) may be borne by the customer
- Shipping & Delivery
- We deliver globally
- Dispatch time for custom artwork: 1–4 weeks (or more, depending on complexity / weather)
- Once shipped, risk passes to you (you are responsible for tracking, customs, etc.)
- We are not liable for delays caused by freight carriers, customs clearance, or force majeure
- Returns, Refunds, & Revisions
- Because artwork is custom / original, returns are very limited
- You may request revisions within 2 days and upto 2 small changes. Additional or full payment on changes like add a new person or object in painting, change a complete color theme, resizing the artwork.
- Refunds (partial or full) may be granted only in exceptional cases (defect, damage) and at our discretion
- To request a refund or revision, you must contact us within 3 days of delivery and provide evidence (photos)
- Intellectual Property & Use Rights
- The artist / we retain copyright in all artwork unless explicitly transferred via written agreement
- You receive a non-exclusive license to use the artwork for personal / agreed usage (e.g. display, sharing)
- Commercial usage, resale, sublicensing, or use in AI models, etc., requires additional licensing / agreement
- You may not remove artist signature / watermark unless agreed
- User Content & Feedback
- Any content you submit (images, text, ideas) is non-confidential, and we may use it (with attribution or without, as agreed)
- You guarantee that any materials you provide do not violate third-party rights
- Limitation of Liability & Disclaimer
- To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability is limited to the amount you paid for the relevant artwork
- We disclaim warranties (express or implied) about merchantability, fitness for purpose, etc.
- Termination & Suspension
- We may suspend or terminate access for breach of these Terms
- You may cancel your order before we begin production (if possible), but may forfeit deposit
- Governing Law & Dispute Resolution
- These Terms are governed by the laws of India
- Disputes shall be resolved in courts in Punjab.
- Changes to Terms
- We reserve the right to update these Terms at any time. Changes take effect when posted. Continued use after changes implies acceptance.
